Terms of Use

These Terms of Use ("Terms") govern your use of the Shekho's Shawarma website and online ordering system (the "Site"), operated by Shekho's Shawarma at 17 St. Paul Street, Thunder Bay, ON. By using the Site or placing an order you agree to these Terms and to our Privacy Policy and Cookie Policy. If you do not agree, do not use the Site.
1. Pickup only — Thunder Bay
Orders placed through the Site are for in-person pickup at our restaurant located at 17 St. Paul Street, Thunder Bay, ON. We do not deliver. We do not ship food. If you cannot come to the restaurant to pick up your order during our posted hours, please do not place an order.
2. Hours and availability
Please only place orders during our posted operating hours. Orders placed while we are closed, or too close to close, may not be prepared. Menu items, prices, and hours can change at any time without notice. Items may sell out; if we cannot fulfill part of your order we will contact you at the phone number you provided.
3. Placing an order
By submitting an order you confirm that:
- The name, phone number, and pickup time you provided are accurate.
- You (or someone you have authorized) will pick up the order at the restaurant.
- You are authorized to use the payment method you entered.
An order is not accepted until you receive a confirmation on the site or by SMS. We reserve the right to refuse or cancel any order for any lawful reason, including suspected fraud, abuse, or an inability to prepare it in time.
4. Prices, taxes, and payment
Prices are shown in Canadian dollars and, unless otherwise stated, exclude applicable taxes, which are added at checkout. Payment is processed by Stripe. You authorize us (through Stripe) to charge your payment method the total shown at checkout.
5. Cancellations, refunds, and mistakes
Food is prepared fresh to order, so we handle refunds and cancellations on a case-by-case basis. If you need to cancel or change an order, or if something is wrong with your food, call the restaurant right away at (807) 630-3800 or speak to us in person. We will do our best to make it right — that may mean remaking the item, offering a substitute, giving credit toward a future order, or refunding all or part of your payment. Refund decisions are at the restaurant's reasonable discretion.
Orders that are not picked up within a reasonable time after the requested pickup time may be discarded for food-safety reasons, and no refund will be issued for a no-show pickup.
6. Food safety, allergens, and dietary information
Our kitchen prepares food that contains, and comes into contact with, common allergens including wheat/gluten, sesame, dairy, egg, soy, tree nuts, peanuts, and garlic. Cross-contact is possible. If you have a food allergy or serious dietary restriction, please speak to us directly at the restaurant before ordering; do not rely solely on the menu or notes field. We cannot guarantee that any item is free of a given allergen and, to the extent permitted by law, we are not responsible for reactions caused by items you chose to order.
Consuming raw or undercooked meat, poultry, or eggs may increase your risk of foodborne illness.
7. SMS notifications
When you enter your phone number at checkout, you consent to receive transactional SMS messages about your order (confirmation, ready, problem, etc.) from us via Twilio. Standard message and data rates from your carrier may apply. Reply STOP to opt out of further messages for that order. See our Privacy Policy for more.
8. Acceptable use
When using the Site you agree not to:
- Place fraudulent, fake, or abusive orders.
- Use someone else's payment method, phone number, or identity without permission.
- Attempt to interfere with, probe, or damage the Site or its underlying systems.
- Scrape, copy, or reuse our menu, photography, branding, or written content without written permission.
- Use the Site in a way that violates any applicable law of Ontario or Canada.
9. Intellectual property
The Shekho's Shawarma name, logo, photography, menu descriptions, and site design are owned by us or our licensors. You may not copy, reproduce, or use them for any commercial purpose without our written permission.
10. Third-party services
The Site relies on third-party services including Stripe (payments), Twilio (SMS), and Lovable Cloud / Supabase (hosting and database). We are not responsible for outages, errors, or data practices of these providers beyond our reasonable control.
11. Disclaimers
The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, that order confirmations will always arrive, or that menu information will always be complete or accurate.
12. Limitation of liability
To the fullest extent permitted by law, in no event will Shekho's Shawarma, its owners, employees, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or in connection with your use of the Site or any order placed through it. Our total aggregate liability to you for any claim relating to an order will not exceed the amount you actually paid for that order. Nothing in these Terms limits any liability that cannot be limited under Ontario or Canadian law (including for gross negligence, willful misconduct, or personal injury caused by our negligence).
13. Indemnity
You agree to indemnify and hold Shekho's Shawarma harmless from any claim, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, or content or information you submitted.
14. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the courts located in Thunder Bay, Ontario, and you consent to their jurisdiction.
15. Changes
We may update these Terms at any time. When we do, we will change the "Last updated" date at the top of this page. Continued use of the Site after a change means you accept the updated Terms.
